Kohima: A promotion dispute within the Nagaland Department of Land Resources Development has escalated to the Supreme Court. Four department officers filed a Special Leave Petition challenging a September 15, 2026, Gauhati High Court judgment. The high court had previously upheld the technical qualification requirements found in Schedule II of the Nagaland Land Resources Development (Services) Rules, 2008.
The Supreme Court bench, featuring Justice Prashant Kumar Mishra and Justice Shree Chandrashekhar, admitted the petition on November 3. They scheduled the next hearing for December 1. The case centers on whether the department can restrict promotions for Deputy Director, Joint Director, and Director positions to those holding specific technical degrees like BSc Agriculture, BSc Horticulture, BSc Forestry, or BE Agriculture.
Petitioners from the department's Extension Wing argue that their role overlaps with the Technical Wing. They contend that common pay scales and frequent transfers imply the wings should have equal promotional standing. They claimed the state failed to honor a tripartite agreement from previous years intended to create new promotion pathways. The state government rejected this, insisting that technical expertise is mandatory for senior leadership roles.
The Gauhati High Court previously sided with the state. The bench led by Chief Justice Ashutosh Kumar and Justice Arun Dev Choudhury stated that the rules had an "intelligible basis" and that judicial review should not interfere with established service qualifications. The court ruled that employees possess no inherent right to be promoted outside of established eligibility criteria, noting that the petitioners failed to prove the rules were arbitrary or unconstitutional.
