Shillong: The Meghalaya High Court tossed a bid to scrap an FIR against four men accused of attacking a police officer. Ajit Das alias Avinash Das, Ara Kumar Hajong, Iasuklang War alias Duh, and Pradip Paul faced charges for obstruction during a limestone quarry raid. They wanted to kill the case. They reached a private settlement with the complainant. The court said no.
The legal fight centers on Shella Police Station Case No. 09 of 2026. The accused asked the Judicial Magistrate First Class in Sohra to drop the charges. They cited the compromise agreement. The High Court rejected that logic. It held that officials cannot sign away criminal cases involving their official duties. The court stated, "A public servant cannot independently consent to the quashing of such proceedings when the alleged offence concerns the discharge of official functions."
Police arrived at the quarry after reports of a man being beaten. The victim was allegedly a Bangladeshi national. A mob of 30 to 35 people stood over him. Police tried to save the victim. The four men blocked them. They used force against the officer on duty. Witness statements back the cops. People at the scene saw the group shove the officer to halt the rescue. These details show a clear violation of the Bharatiya Nyaya Sanhita. The case moves forward. The trial court will now weigh the evidence without outside pressure.
