An IAS officer in Nagaland, accused of sexually assaulting two tribal minors. Five years later, he still draws a government salary

In February 2021, two minor girls from the Khiamniungan tribe in eastern Nagaland accused their district's most powerful civil servant of sexual assault at his official residence. A Special Investigation Team filed a chargesheet that December. The law promised them a trial within one year. Five years later, the trial continues. The accused remains on the government payroll.

This editorial examines not the guilt or innocence of Reny Wilfred, but the institutional architecture that has allowed a civil servant facing serious criminal charges to remain employed, promoted, and protected by the very state machinery sworn to uphold the law. The question is not whether the legal system is slow. It is whether the executive branch has chosen inertia over accountability.

Reny Wilfred has denied all charges and maintains his innocence. This editorial examines the institutional response to those charges, not their merits.

The facts are documented and stark. The Protection of Children from Sexual Offences Act mandates trial completion within one year of cognisance. Wilfred's case has been pending since 2021. In July 2023, the Supreme Court dismissed his petition to transfer the trial out of Tuensang district, noting dryly that local protests would not affect the judge. The court allowed him to appear virtually, a courtesy extended to a man accused of molesting minors while ordinary undertrials languish in crowded jails. The executive response has been measured in years, not days. The Nagaland government relieved Wilfred of his duties at the Investment and Development Authority of Nagaland only in April 2025, after a second FIR was registered. He was suspended only in May 2025, four years after the POCSO case began and months after new charges emerged. Even then, the order came only after sustained pressure from the Naga Students' Federation and tribal women's organisations who marched to the Governor's residence. This is not an isolated failure of one department. Wilfred was posted to IDAN as Joint Secretary in 2021, the same year the POCSO case was registered. He became head of a department where most employees were contractual workers, their job security resting on his signature. When women complained of harassment, IDAN had not even constituted an Internal Complaints Committee under the PoSH Act. The committee was formed only in March 2025, after the scandal broke. An accused is entitled to the presumption of innocence and the full armoury of legal defence. Wilfred has exercised these rights through multiple petitions to the High Court and Supreme Court. But the right to defend oneself does not include the right to draw a government salary while doing so, nor the right to supervise subordinates who have accused one of harassment.

The Naga Students' Federation has warned that it will not allow Wilfred to enter the Civil Secretariat if justice continues to be delayed. Tribal women's bodies have demanded that if convicted, he be permanently barred from holding any government post in Nagaland. Whether the state government listens will tell us whether Nagaland is governed by the rule of law or by the rule of bureaucratic privilege.
