Tripura High Court Overturns Bar Association Boycott Penalty Against Lawyer

Agartala: The Tripura High Court has ruled that the District Bar Association lacks the authority to penalize lawyers for fulfilling their professional duties during court boycotts. Justice Dr. T. Amarnath Goud issued an order on May 11 staying a retaliatory show cause notice issued against advocate Sampad Choudhury, affirming his right to appear in all courts without interference.

The conflict arose after the Tripura Bar Association (TBA) passed a resolution on January 19, mandating that members boycott court proceedings, specifically targeting the District Consumer Disputes Redressal Commission in Agartala. Despite the directive, Mr. Choudhury appeared before the commission on February 6, prioritizing his obligations to his client. Following his appearance, the TBA issued a show cause notice against him for allegedly defying the association's general body resolution.

Justice Goud’s ruling ensures that Mr. Choudhury can continue his practice without threat of suspension or disciplinary action from the association. The court’s decision underscores the primacy of legal ethics and the duty to the court over administrative mandates imposed by local bar bodies.
