Shillong: The Supreme Court may soon send a major legal question to a larger Bench. Justices Manoj Misra and Shree Chandrashekhar are reviewing whether minor defects in an arrest memo can void an arrest. This move follows a challenge by the Meghalaya government against the bail granted to Sonam Raghuvanshi.
Sonam faces charges for the May 2025 murder of her husband, Indore businessman Raja Raghuvanshi, during their honeymoon. Prosecutors claim she worked with hired killers to end his life. The case gained national notice due to its violent nature.
A lower court previously granted Sonam bail because the arrest documents cited the wrong legal provision and lacked written grounds for the detention. Solicitor General Tushar Mehta argued that the error was just a simple typo. He insisted that such mistakes should not outweigh the severity of murder charges. Mehta stated, "The incorrect provision mentioned in the arrest memo was merely a clerical or typographical error and did not prejudice the accused."
The Justices did not cancel her bail yet. Instead, they ordered the state to hand over original arrest records for closer inspection. The final ruling will settle if administrative slips in police paperwork are enough to spring a murder suspect from jail.
