Sikkim High Court Defers Voter Roll Revision Case to Supreme Court

Gangtok: The High Court of Sikkim has declined to hear a petition challenging the Special Intensive Revision of electoral rolls in the state. A division bench, led by Chief Justice A. Muhamed Mustaque and Justice Bhaskar Raj Pradhan, ruled that the court should not examine the issue while related proceedings remain active before the Supreme Court.

The court advised the petitioner, the Sikkimese Moolniwasi Suraksha Sangh, to either approach the Supreme Court directly or file for a transfer of the case. The matter has been adjourned sine die as the petitioner prepares its next legal steps. Legal sources suggest that the organization is currently consulting on the matter and plans to move toward the apex court in the coming days.

The original Public Interest Litigation did not ask for a stay on the revision process. Instead, it requested a fairer execution of the exercise, specifically asking for a reconsideration of the cut-off year used to establish voter eligibility. The petitioner argued that the process must respect the state's unique legal standing, stating that the issue "carries significant implications for Sikkim in view of the state's special constitutional protections under Article 371F of the Constitution."
