Meghalaya High Court Rules Moral Objections Cannot Close Licensed Liquor Shops

Shillong: The Meghalaya High Court ruled that moral pushback from church leaders and local residents carries no weight against a legally licensed liquor business. Justice H.S. Thangkhiew ordered officials to let a shop owner operate her Indian Made Foreign Liquor retail outlet in Danakgre, West Garo Hills.

The owner previously secured a no-objection certificate from the local Nokma and received official permission from the Excise Department in January 2025 to relocate from Jengjal market. Despite these valid credentials, the Superintendent of Excise ordered the shop closed after local groups complained. The court found no breach of the Meghalaya Excise Act. Officials confirmed the shop sits more than 200 metres from any church, school, or hospital.

Justice Thangkhiew stated, "The objections were based solely on moral considerations and not on any legal or substantial grounds."

Official reports noted that a separate bar functions just 105 metres away. The court observed that illegal liquor sales remain common in the area and suggested that a licensed outlet could actually help control the black market. While the court noted that citizens lack a fundamental right to sell alcohol, it maintained that a granted licence creates a protected legal right. Authorities must now allow the shop to open.
