Guwahati: The Gauhati High Court hit the brakes on a land seizure in Golaghat. Justice Manish Choudhury issued the order on August 20, 2026, stalling the state's move to take over 211 bighas, 1 katha, and 19 lessas of property at Rajabali Bagan. The district government wanted this land for an industrial estate linked to Numaligarh Refinery Limited.
Trouble started May 6, 2026, when the Golaghat District Commissioner requisitioned the site under the Assam Land Requisition and Acquisition Act. Mouchak Agro LLP fired back with an appeal on May 29. They relied on Section 3(3) of the law to contest the grab. Yet, the government issued a demand on July 28 ordering the firm to hand over the site in ten days. That order is now dead in the water.
The court ruled that the government must hear the appeal before forcing the company off the land. Justice Choudhury stated, "A person affected by a requisition has a statutory right to challenge the order." This right takes priority over possession orders. The state government admitted to the court that the company's appeal is still sitting in their inbox. Until they process that paperwork, the property stays with the current owners.
