Sikkim Court Orders FIR Against MLA Kala Rai in Property Demolition Case

Gangtok: A civil court in Gangtok has directed the local police to register an FIR and investigate Upper Burtuk MLA Kala Rai regarding the demolition of a structure near STNM Hospital. The order, issued by Civil Judge Nairitya Sharma on May 20, 2026, stems from a complaint filed by Sonam Pintso Bhutia under the Bharatiya Nagarik Suraksha Sanhita.

The complainant alleges that on April 8, 2026, the MLA arrived at the site with associates and laborers to tear down a building. According to the court records, the complainant claims that the property was already subject to pending legal proceedings before the District Collector and District Magistrate. The complaint further alleges that the group threatened those who objected to the destruction, resulting in an altercation at the site.

While police investigators initially argued that no criminal case existed and that the structure was built illegally on public land, the court found the allegations presented sufficient grounds for a formal investigation. Citing Supreme Court mandates on cognisable offences, Judge Sharma concluded that police must examine electronic evidence and determine individual responsibility before filing a formal report.
